By accessing or using MailWise ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

MailWise is an AI-powered email management platform that helps users:

  • Automatically categorize and prioritize emails
  • Generate AI-powered email summaries
  • Create reminders and track action items
  • Search and filter emails efficiently
  • Manage email workflows and responses

3. User Accounts

3.1 Account Creation

To use MailWise, you must create an account by connecting your Gmail account via OAuth 2.0. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Requirements

  • You must be at least 13 years old to use the Service
  • You must provide accurate and complete information
  • You are responsible for all activities under your account
  • You must notify us immediately of any unauthorized access

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activities.

4. Subscription and Billing

4.1 Pricing Plans

MailWise offers multiple subscription tiers:

  • Free Plan: Limited features and email processing
  • Starter Plan: £23/month - Enhanced features and limits
  • Professional Plan: £63/month - Premium features and priority support

4.2 Payment Terms

  • Subscriptions are billed monthly in advance
  • All payments are processed securely via Stripe
  • Prices are subject to change with 30 days notice
  • Prorated billing applies when changing plans mid-cycle

4.3 Refund Policy

  • Free Plan: No charges apply - no refunds needed
  • First-time subscribers: 7-day money-back guarantee from initial purchase date
  • Renewals and plan changes: No refunds issued, but you can cancel anytime
  • To request refund: Email shailaja.natarajan@sjrtchsrv.tech with your reason within 7 days

The 7-day refund window applies only to your first paid subscription. Subsequent renewals, upgrades, or downgrades are not eligible for refunds. You maintain full access until the end of your billing period after cancellation.

4.4 Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain full access until the end of your current billing period. No refunds are provided for partial months or unused time, except during the 7-day money-back guarantee period for first-time subscribers.

5. Acceptable Use Policy

🚫 You may NOT use MailWise to:

  • Violate any laws or regulations
  • Send spam, phishing emails, or malicious content
  • Infringe on intellectual property rights
  • Harass, abuse, or harm others
  • Attempt to gain unauthorized access to systems
  • Reverse engineer or decompile the Service
  • Use automated tools to scrape or extract data
  • Resell or redistribute the Service

6. Gmail API Usage

MailWise uses the Gmail API to access your email. By using the Service, you also agree to comply with Google's Terms of Service and API Usage Policies:

7.1 MailWise Property

All content, features, and functionality of MailWise, including but not limited to text, graphics, logos, software, and design, are owned by MailWise and protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain all rights to your email data. By using MailWise, you grant us a limited license to process, store, and display your data solely for the purpose of providing the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability or fitness for a particular purpose
  • Accuracy, reliability, or completeness of content
  • Error-free or uninterrupted operation
  • Security of data transmission or storage

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAILWISE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or goodwill
  • Service interruption or data breaches
  • Errors or inaccuracies in AI-generated content
  • Third-party actions or content

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless MailWise, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Violation of these Terms
  • Infringement of third-party rights
  • Your content or conduct

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

14.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through:

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MailWise regarding the Service and supersede all prior agreements.
